Anti-Spam Policy

All bulk e-mail, including unsolicited bulk or unsolicited commercial e-mail, as well as the sending, aiding and commissioning the transmission of commercial e-mail that does not conform with the US CAN-SPAM Act of 2003 (SPAM) is prohibited under Wesbytes.com’s Zero Tolerance Policy. E-mails sent by you or on your behalf must not breach this legislation. This is your responsibility. Unless we are given with reliable evidence to the contrary, we take SPAM concerns seriously. You may not send unsolicited bulk e-mail using our system or network. E-mails sent to or through our network and services may not include any content that:

It is against the law for Wesbytes to allow harvesting, mining, or gathering of e-mail addresses and other information from its network. You can’t get your hands on Wesbytes’s Subscribers’ e-mail addresses without permission from Wesbytes, and you can’t get your hands on Wesbytes’s network or services without permission from us. Our User Agreement, AUP, and other Terms of Service also apply to your use of our network or services. This includes any effort to use Wesbytes’ network or services in a manner that might damage, disable, overburden or impair any aspect of our services, or interfere with the use and enjoyment of any of our products and services by any third party.
All communication to and from our servers is monitored for SPAM. Customers who are suspected of utilising Wesbytes goods and services to transmit SPAM will be examined. Unless we get reliable evidence to the contrary, we believe SPAM complaints are real. A Wesbytes Web site or account that sends SPAM will be promptly suspended, terminated, and/or cancelled.
To ensure that a recipient’s express consent was gained before a mailing was sent, subscribers may be required to present proof of that authorization. Wesbytes may deem a mailing suspicious if there is no indication of express affirmative consent.
Open mail relays are not permitted on the servers of subscribers. This (the open mail relay’s) activity cannot be justified by claiming ignorance of its existence or functioning. Members are forbidden from providing services for websites contained in SPAM, including but not limited to hosting websites or providing DNS services or web site redirection.
To violate this policy or relevant legislation, even if a third party does not utilise Wesbytes systems, networks, or resources, is to commission the sending of e-mail that is in violation of this policy or applicable law. Email that does not comply with this policy – regardless of source – that contains any reference to a Wesbytes-hosted website or a connection to Wesbytes’ network or system is forbidden.
To prevent illegal or inappropriate use of our network or products and services, Wesbytes has the right to block communications from a certain internet domain or mail server or IP address at any time without warning. You may be promptly suspended, terminated, and/or cancelled by Wesbytes if it judges in its sole judgement that you are transmitting or are otherwise linked with an e-mail that violates this policy.
All services supplied to a Subscriber by Wesbytes are subject to immediate suspension, termination, and/or cancellation by Wesbytes without prior notice. A subscriber who violates any of the terms and conditions of this SPAM Policy, Acceptable Use Policy, or User Agreement, or who uses our services in a way that disrupts or, in Wesbytes’s sole judgement, could disrupt our business operations, will be charged an administrative fee of $100.00 for each piece of SPAM sent, in addition to any and all other rights granted under this Agreement or otherwise.

All e-mails that are sent to or through our network or services are prohibited by this policy. Wesbytes’ rights are not waived if this policy is not strictly enforced.
Wesbytes reserves the right to pursue civil and criminal penalties against anyone who sends or assists in the transmission of unsolicited e-mail, including those provided by the Computer Fraud and Abuse Act (18 U.S.C. 1030, et al.) and other state and federal laws.
